The Appeals Chamber of the International Criminal Court (ICC) is set to deliver its decision on the appeal filed by former President Rodrigo Duterte, challenging the court’s jurisdiction over his case.
In a scheduling order dated April 2, the Appeals Chamber announced that the judgment will be released on April 22 at 11:00 a.m. at the ICC headquarters in The Hague, The Netherlands.
The proceedings will be open to the public and livestreamed through the court’s official website. The order was signed by Presiding Judge Luz del Carmen Ibáñez Carranza.
The appeal stems from an earlier ruling issued on October 23, 2025, by ICC Pre-Trial Chamber I, which dismissed Duterte’s challenge to the court’s authority. The chamber maintained that the ICC retains jurisdiction over alleged crimes committed in the Philippines while it was still a State Party to the Rome Statute.
Duterte’s legal team has urged the Appeals Chamber to overturn the decision, arguing that there is no legal basis for the continuation of proceedings against the 81-year-old former leader. They have also sought his immediate and unconditional release.
Duterte, who was arrested in March 2025, recently marked his 81st birthday in detention in The Hague—his second year in custody. He has declined to attend hearings related to the confirmation of charges, consistently asserting that he does not recognize the ICC’s jurisdiction over him.
The forthcoming decision on April 22 is expected to determine whether the ICC’s case against Duterte—linked to alleged crimes against humanity during his administration’s anti-drug campaign—will move forward.
