Department of Justice (DOJ) Prosecutor General Richard Anthony Fadullon said government contractor Sarah Discaya could have her sentence reduced or liability lessened if found guilty, in accordance with the law.
“Let’s say magkaroon ng sentensya, naghearing na its time for the court to come up decision, the court will consider mitigating circumstances aong them for example would be voluntary surrender, plea of guilt that’s something that will lessen the penalty,” Fadullon explained.
The statement came after Discaya voluntarily surrendered to the National Bureau of Investigation (NBI) amid her case involving anomalous flood control projects.
Fadullon also noted that under the Witness Protection Program (WPP), an accused who becomes a state witness may be required to return ill-gotten funds if obligated, even though restitution is not explicitly mandated by law.
He added that the Discayas have not yet provided a full disclosure, as only names have been mentioned and sufficient evidence is still lacking.
