KAUFMAN: ICC CASE VS. DUTERTE IS EVIDENCE-BASED

Defense counsel Nicholas Kaufman emphasized Friday that proceedings at the International Criminal Court (ICC) against former President Rodrigo Duterte are a legal process grounded in evidence, not a spectacle.

“The judges will take their decision based on the evidence. The evidence has been presented by the prosecution and challenged by us, the defense, and we trust the judges to make the right decision,” Kaufman said after the conclusion of the confirmation of charges hearing.

The ICC’s Pre-Trial Chamber I is expected to issue a ruling within 60 days. The chamber may:

  • Decline to confirm the charges, though the prosecution may resubmit with additional evidence.
  • Adjourn the hearing to request further evidence, investigation, or amendments to the charges.
  • Confirm the charges and commit the case for trial, after which a Trial Chamber will oversee proceedings.

The chamber’s decision will determine whether the case moves to trial or requires further prosecutorial action.
