Vice President Sara Duterte’s defense team is accelerating efforts to appoint a new public representative following the impeachment court’s strict enforcement of the sub judice rule, which restricts legal counsel from discussing case details publicly.
The tightening restriction leaves Atty. Michael Poa in a difficult position as he currently serves dual roles as defense counsel and spokesperson.
During a press briefing on Wednesday, August 26, Poa acknowledged that continuing both duties poses legal risks, as public inquiries could force him to address the case’s merits and potentially trigger court sanctions against the legal team.
“So sa atin, medyo risky na rin talaga kasi, and there are times when your questions also would put us in a corner to answer certain things that might delve into the merits, and it’s not your fault, of course, you’re just doing your job,” Poa stated.
Senator Francis “Chiz” Escudero, presiding over the impeachment court, reiterated his recommendation for both sides to name dedicated spokespersons who are not bound by the specific conduct rules imposed on participating litigators.
Expressing full respect and compliance with the court’s directive, Poa confirmed he has discussed the matter with Duterte, noting that finding a non-lawyer representative has become a priority.
“Wala pa, but I think it’s definitely important to have one,” Poa said regarding the pending replacement. “So siguro ngayon meron lang sense of urgency.”
