QUEZON CITY, Philippines — 1-Rider Party-list Representative Rodge Gutierrez has called on authorities to guarantee the fair and proper implementation of the No Contact Apprehension Policy (NCAP) as the automated traffic enforcement system resumes operations on Monday, October 5.
Gutierrez stated that his group will closely monitor the policy’s renewed enforcement to confirm whether it is applied consistently while safeguarding the rights and safety of motorists, particularly motorcycle riders.
“Naninindigan kami na hindi dapat maparusahan ang mga motorista dahil sa mga pangyayaring hindi nila kontrolado,” the party-list said.
The group emphasized that traffic enforcement must consider factors that motorists cannot reasonably control, such as hazardous road conditions, missing or unclear traffic signs, defective infrastructure, and unexpected maneuvers by other vehicles.
“Traffic enforcement must distinguish clear violations from situations arising from poor road conditions, unclear or missing signage, defective infrastructure, sudden lane changes by other vehicles, or other circumstances beyond a motorist’s reasonable control,” it noted.
1-Rider also warned against using automated cameras as absolute proof for issuing tickets, stressing that authorities must evaluate the specific context behind every reported violation.
“A camera-based system cannot be allowed to operate as an automatic penalty machine without accountability for these realities,” it said.
The party-list pointed out that when the Metropolitan Manila Development Authority (MMDA) previously restarted NCAP operations on major Metro Manila roads in May 2025, 1-Rider expressed concerns regarding limited avenues for contesting tickets, delayed notices, and due process deficiencies.
While acknowledging the improvements later made by the MMDA to resolve those gaps, the party-list urged local government units (LGUs) operating their own NCAP systems to adopt similar levels of transparency, responsiveness, and accountability.
Furthermore, 1-Rider urged motorcycle riders and drivers to document and submit feedback on their experiences under the restarted policy, including notice delivery, the validity of evidence, and any issues faced when contesting fines.
According to the group, motorist feedback will be vital in helping LGUs, the MMDA, and other agencies assess whether NCAP is working fairly and effectively on the ground.
“Ang NCAP ay dapat maging katulong sa paglutas ng problema sa trapiko, hindi dagdag na pasakit sa mga motorista at riders na naghahanapbuhay,” it concluded.
