The Quezon City Regional Trial Court (RTC) Branch 81 has thrown out a petition filed by Atty. Mans Carpio intended to stall the impeachment proceedings against his wife, Vice President Sara Duterte, citing a “lack of jurisdiction.”
In addition to dismissing the main petition, the court denied Carpio’s request for a writ of preliminary injunction directed at Speaker Faustino “Bojie” Dy III, House Committee on Justice Chairperson Gerville Luistro, and Bureau of Internal Revenue (BIR) Commissioner Charlito Martin Mendoza.
Presiding Judge Madonna Echiverri, in a five-page order dated May 6, 2026, ruled that the court did not have the authority to intervene in the matter.
The decision effectively neutralized the legal attempt to block the legislative process through a petition for prohibition.
“The petition for prohibition is DISMISSED for lack of jurisdiction. The prayer for issuance of a writ of preliminary injunction is DENIED,” the court ruling stated.
The House of Representatives received the formal ruling, which confirms that the judicial branch will not interfere with the ongoing impeachment functions of the legislature in this specific instance.
