The International Criminal Court (ICC) Trial Chamber III on Monday approved the withdrawal of lawyer Nicholas Kaufman from the defense team of former Philippine President Rodrigo Duterte.
The decision, contained in a five-page document, noted that the change in legal representation would not disrupt the ongoing case. The Chamber found that the transition was per the wishes of the accused, who intends to hire a new legal team.
“Having considered the present stage of the proceedings and the aforementioned factors, the Chamber is of the view that no prejudice arises or inconvenience is caused by accepting Mr. Kaufman’s withdrawal,” the Chamber stated.
According to the ruling, Kaufman filed his request on May 8, explaining that Duterte wished to release him from his duties to appoint a replacement.
Kaufman further confirmed that he had briefed his successor, who is prepared to take over immediate representation and manage all upcoming deadlines.
“The request notes that Mr. Kaufman has spoken to his replacement counsel, who has confirmed that he is willing and able to assume immediate representation of the Accused and that his terms of engagement have been agreed,” the document added.
The incoming counsel is expected to attend the next status conference on May 27, though the name of the new lawyer remains redacted in public records.
The Chamber reminded Kaufman that despite his exit, he remains bound by the Code of Professional Conduct and strict confidentiality regarding the case.
The decision was issued by Presiding Judge Joanna Korner, alongside Judges Keebong Paek and Nicolas Guillou. Duterte remains in ICC custody as he faces charges of crimes against humanity involving alleged extrajudicial killings during his tenure as Davao City mayor and President of the Philippines.
