SC RULES SENIOR CITIZENS CANNOT COMBINE PROMO RATES WITH THE 20% DISCOUNT

MANILA, Philippines — Senior citizens purchasing goods or services must select either a promotional rate or their statutory 20% discount rather than stacking both, according to a recent ruling by the Supreme Court.

During its en banc session on Wednesday, October 14, the High Tribunal clarified that businesses are not required to layer the mandatory senior citizen discount on top of an existing promo price. The justices emphasized that granting simultaneous discounts would create an unfair advantage for consumers while placing an unjust burden on business owners.

Maintaining a fair balance between consumer welfare and commercial viability is essential, the Court noted.

“The State’s pursuit of public welfare cannot be allowed to impose undue or confiscatory burdens on private establishments, whose continued viability is essential to the long-term effectiveness of the law,” the SC stressed.

While the complete text of the decision remains pending on the official judiciary portal, details were outlined in a press briefer from the Supreme Court Office of the Spokesperson.

The ruling resolved a petition under GR No. E-00464 involving Orville U. Ong, the general manager of a Bacolod City hotel. Ong had faced charges for violating Republic Act No. 7432, or the Senior Citizens Act, as amended.

The legal battle began when guests Paul S. Alcazaren, 66, and Eric Gadiana, 70, filed a complaint after being denied an additional senior discount. Ong defended the hotel’s position, explaining that the guests had already received a 20 percent reduction through a special negotiated group rate for the Cebu Bikers Club, which was integrated directly into their final bill.

Although lower tribunals—including the Municipal Trial Court in Cities, the Regional Trial Court, and the Court of Appeals—successively convicted Ong, the Supreme Court ultimately overturned those rulings and acquitted him.

The High Court reiterated that because the guests already received an equivalent discount through the group promotional rate, the establishment was legally justified in declining to apply a second 20 percent reduction.
