BACOOR CITY, Cavite — A local regional trial court has sustained the conviction of actor Archie Alemania in connection with the acts of lasciviousness charge filed against him by fellow performer Rita Daniela.
The Bacoor Regional Trial Court (RTC) Branch 116 rejected Alemania’s appeal, maintaining the original October 2025 ruling issued by the Bacoor Municipal Trial Court (MTC) in Cities Branch 2. The lower court found the actor guilty beyond reasonable doubt under Article 336 of the Revised Penal Code, following an incident between the two personalities in Bacoor City on September 9, 2024.
In rejecting the appeal, the RTC affirmed the prosecution’s presentation of evidence against the accused.
“This court is convinced and satisfied that the evidence tendered by the prosecution for the purpose of establishing the guilt of the accused beyond reasonable doubt warrants the conviction of the accused,” the court stated in its ruling.
Reacting to the decision, Daniela’s legal counsel, Atty. Maggie Abraham-Garduque, shared that her client was pleased with the judicial outcome.
“Rita is very happy about it. This shows that the decision of the MTC convicting Archie for acts of lasciviousness is correct,” Abraham-Garduque said.
The lawyer added that because Alemania opted to appeal the lower court’s decision instead of applying for probation, he will be required to serve his jail time once the judgment becomes final.
The original MTC ruling carries a prison term ranging from one month and one day to one year and one day. The trial court noted that Daniela’s testimony was corroborated by supporting evidence, including statements linked to Alemania, a text message, and an unanswered phone call.
Alemania has yet to issue a public statement regarding the denial of his appeal.
